This privacy policy provides information about how your personal information as a client is collected, shared, stored, and used within our practice. It is important for your confidence that you understand how this information is stored and managed responsibly. Australian Government Privacy Legislation applies to personal information collected about an individual that could be used to identify them directly or indirectly. This policy outlines ways in which Oletta Faye Counselling handles personal information of our clients. We take privacy seriously and are committed to complying with the Australian Privacy Principles in the Privacy Act 1988 (Cth). Sharing Personal Information
Personal Information is any information about an individual that can be used to identify them directly or indirectly, such as name, address, phone number, email address, and date of birth. Sensitive Information is a type of personally identifying information which may include health information, racial or ethnic background, religious or political beliefs, sexual orientation, criminal history, or other information considered sensitive under privacy legislation.
When you register as a client of our practice, you provide consent for our staff to access and use your personal information. The sharing of personal information by a client to Oletta Faye Counselling assists us in providing the healthcare services to you. Personal information is retained to enable us to provide a relevant and informed service. Only staff who need to see your personal information will have access to it. If we need to use your information for anything else, we will seek additional consent from you to do this. Within our practice, and due to our duty of care, a client cannot be anonymous.
Collection, Storage, Use and Disclosure of Personal Information
We collect personal information through a variety of means, including:
information you share verbally with us in person, over phone, or video calls
written communication received via email, text, letter, etc.
our website, contact form and online booking system
our intake form
a referral from your GP, another treating practitioner, support person, or service.
All communication, including booking forms, contact forms, email, text messages, phone calls, and written correspondence may be recorded and stored as part of your client record. To protect personal information we hold from misuse or loss, all information is stored securely and only accessible by approved individuals. Our Wix website and online booking system, Acuity, may collect personal information when you submit an enquiry, complete an intake form or booking. This information may be processed and stored through third party service providers used to operate our website, booking, Telehealth, and communication systems. All online payment information is processed securely through our online payment portal, Stripe. These providers may store data on servers located in Australia or overseas and operate under their own privacy policies. We take reasonable steps to ensure that any third-party systems used are secure and compliant with applicable privacy legislation and this policy. By using our online booking system, you consent to the processing of information and data about you by Wix, Acuity, and Stripe.
If we become aware of a security breach, we will promptly investigate and, where appropriate, take remedial action and notify the individual affected in accordance with the Privacy Act.
We will not disclose personal information about you to third parties without your consent, except when
1. Failure to disclose the information would in the reasonable belief of your counsellor place you and/or another person at serious risk to life, health, or safety
2. Your prior approval has been obtained to
a. Provide a written/verbal report to another professional or agency, for example, a GP or a lawyer; or
b. Discuss the material with another person, for example, a parent, carer, guardian, partner or employer.
3. Required to release client records under a court order or subpoena
4. Disclosure is otherwise required by law, including putting property at risk or admitting having committed a crime or forming the intention to do so
5. Required to report any concerns of abuse, neglect, or risk of harm to a child or young person under the age of 18.
You may request access to personal information we hold about you. We require you to put this request in writing by emailing info@olettafayecounselling.com. We may ask you to specify what information you require and may charge a fee where we provide access. We deal with all requests for access to personal information as required by the Privacy Act and within 30 days of receiving your request. We may refuse to provide access if the Privacy Act allows us to do so. You may request to update or change your personal information. We will deal with such requests as required by the Privacy Act.
Complaints
If you think your personal information has not been handled in accordance with the Privacy Act, please contact us at info@olettafayecounselling.com. We will investigate your complaint and try to promptly resolve directly with you. If you are not satisfied with the outcome, then you may make a complaint to the Office of Australian Information Commissioner (OAIC).
